Article 1 - Scope of application
The present general condition of sales apply, within the framework of the service of remote sale of the company PLANETE-SFACTORY / NOZA DISTRIBUTION (us), to all the sales concluded by the means of the internet site www.planete-sfactory.com, as well as the orders placed by telephone, or send by mail to the attention of our customer service, with its clients (you). We may amend these terms and conditions of sale at any time, provided that we post such amendments on our website.
Article 2 - Price
2.1 The prices of our products are indicated in Euros, excluding taxes and shipping and handling costs.
2.2 For all the products shipped outside of the European Union and French overseas departments and territories, the price will be calculated without taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable.
Those rights and sums do not fall within the competence of NOZA DISTRIBUTION. They will be charged to the customer (you).
2.3 All the orders, no matter their origins, are payable in Euros.
2.4 Promotional prices: Promotions are offered on our products at fixed and delimited periods. If several promotions are running on the same product, at the same time, NOZA DISTRIBUTION reserves the right to allow the customer to benefit from the most advantages promotion, the promotions are not cumulative.
2.5 NOZA DISTRIBUTION reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time the order is registered subject to availability. The information relating to prices and availability of products may be subject to change and are given for information only.
Article 3 - Validation of your order
We are bound to accept your order under the terms of these general conditions of sale:
- You must declare that you are at least 18 and have the legal capacity to place an order on our website www.planete-sfactory.com.
- NOZA DISTRIBUTION reserves the right to ask you for a copy of your identity card to confirm your account in case of doubt, in order to fight against fraud on the internet, and undertakes not to communicate this information.
- www.planete-sfactory.com reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous or fraudulent order.
- When you click on the "Validate" button after the order process, you declare that you have read and accepted the present general terms and general conditions of sale in full and without reservation. Your order is therefore validated subject to the total amount of the order being paid.
- In the absence of payment, the order will be considered null and void.
Article 4 - Availability
Our product offer and prices are valid as long as they are visible on the site, within the limits of available stocks. Information on the availability of products is provided at the time of placing the order when adding your product to the basket, and is provided for information only. In case of unavailability of the product after placing your order, we will inform you by email, telephone, or mail as soon as possible. You will then be able to request the cancellation or exchange of your order.

- In case of total unavailability of the goods, your order will be canceled, and you will be reimbursed by cheque or re-credit on the credit card used at the time of purchase within 10 days according to the original method of payment.
- In case of partial delivery, our customer service will contact you to obtain your agreement for an exchange or a refund.
Article 5 - Delivery
The products are delivered to the delivery address you indicated during the ordering process. If you choose to pay by cheque or bank transfer, the order will only be processed on receipt of payment. Consequently, the delivery times applicable in this case are those on the day of receipt of the cheque or bank transfer and may therefore be modified in relation to those mentioned on the day the order was placed. If you encounter a delivery problem due to the carrier (for example: delay in delivery - order not received), please contact our customer service within 30 days of the date of validation of your order. After this period, we will not be able to refund your order.
WARNING! When receiving your package, please check the condition of the goods transported and not of the packaging in the presence of the delivery person and systematically apply precise reserves on the receipt: shock, dent, scratches on the product concerned, and refuse it.
Without these reservations describing precisely the damage, we will not be able to make a complaint to the carrier.
In case of refusal of the deliverer or the counter to check the contents:
- Either you refuse the package.
- Either you indicate that you have been refused the opportunity to check the contents of the parcel on the delivery note that you will sign.
By signing the delivery receipt, apart from any specific reservations and accepting the products, the customer acknowledges having received the goods in a condition that gives him complete satisfaction. Therefore, any claim related to the condition of the delivered products cannot be received, and any return will be at the customer's expense.
Article 6 - Shipping costs
The shipping costs include a contribution to the costs of preparation and packaging + the costs of postage.

In the case of a return for a lack of address, the cost of re-delivery will be at your expense. In the case of incomplete, used, or damaged products, S-factory may apply a discount to the refund.

Article 7 – Customs tax
Please note that customs or import taxes are not included in the shipping costs indicated. These taxes remain entirely at your charge and are your responsibility. As taxes may vary according to your country, we invite you to contact the relevant authorities.
Article 8 - Payment
There are various means of payment available to you:
Payment by credit card
To avoid any risk of misappropriation of your bank card, S-FACTORY uses a secure payment system with SSL standards, the safest and most widespread encryption protocol currently in use.
Your bank details are directly encrypted (to the maximum standards authorized by the authorities, i.e., 128 bits) and routed to our payment organization (the Credit Mutuel) without passing through our site. S-FACTORY never receives the bank authorization. It is directly managed by the bank.
Planete-sfactory does not store any banking information.
On your bank statement, the debtor will be NOZA DISTRIBUTION, the name of our company. We accept National credit cards, Eurocard/Mastercard, Visa, and American Express.
We remind you that our transactions are carried out in a secure environment thanks to a redirection to the Credit Mutuel server.
Payment by cheque
For your order to be processed, the payment cheque must be signed and made out to NOZA DISTRIBUTION / PLANETE-SFACTORY. The cheque must be issued by a bank domiciled in France or in Monaco and made out in Euros.
Please enclose your order confirmation or indicate your number on the back of your cheque or in plain paper with your cheque to identify yourself on receipt.

Your order will be definitively validated, and delivery triggered from the date of receipt of the cheque.
Payment by bank transfer
After validating your order, you will receive an email confirming your order, giving you our bank details. You will then be able to transfer the total amount of your order from your bank.

Article 9 - Reservation of ownership
The products shall remain the property of S-FACTORY until full payment of the price, plus interest where applicable. This provision shall not prevent the transfer to the customer of the risks of loss or deterioration from the moment the products leave our premises.
Article 10 – Returned goods
According to the law, you have 14 days to inform us of your right of withdrawal, followed by a further 14 days to return the item concerned after agreement by our company.
The right to withdrawal does not apply to engraved/personalized items. Consequently, these products are neither exchangeable nor refundable.
You must contact our customer service department on 03 21 60 01 40 or by email at contact@planete-sfactory.com before returning any goods.
A withdrawal form will be provided to you by email or by post, depending on your choice, to return the item.
You will be responsible for the cost of returning the item.
In case of defective, damaged, or non-conforming reception following an anomaly in the order, please also contact our after-sales service, which after agreement will send you a postal return form.
Any return made outside France will be at your expense. We will reimburse you for the delivery costs on presentation of the invoice (maximum €13).
Please see our RETURN PROCEDURE before returning any goods.
Caution: No return of goods will be accepted without prior agreement from us. For reasons of hygiene and safety, products such as E-liquid, clearomizers, drippers, e-cigarette kits, and batteries cannot be returned or exchanged if they have been used.
Exclusion of returns
Items engraved or personalized will not be returned or exchanged unless we make a mistake.
The exercise of the right of withdrawal gives rise to a refund of the sums paid at the time of the order as soon as possible and at the latest fourteen (14) days from the date on which you exercised this right.
However, we may defer the refund until we have received the goods or you have provided proof of dispatch of the goods, whichever is the earlier. Refunds will be made according to the payment methods used for the online purchase. Please ensure that you retain proof of dispatch of your return, such as a written statement from a transport or postal service provider indicating the sender and recipient of your return and providing that the goods were actually sent. In particular, if your return is not received by our warehouse, we may ask you for proof of shipment. If you return your order in full, we will refund the original delivery charge; except for any additional charges arising from the fact that you have chosen a delivery method other than the cheaper standard delivery method offered by our company, in accordance with the law. The partial return of a part of the products ordered will result in the reimbursement of the returned product(s). The initial delivery costs will not be refunded as the amount of our delivery costs is fixed and does not depend on the number of products ordered.Article 11 - Legal guarantee of the seller
All products are purchased on the S-Factory website are covered by the seller's legal warranty of two years (from the date of delivery) against defects in conformity in accordance with the provisions of the consumer code and by the seller's legal warranty against hidden defects in accordance with the provisions of the civil code.

In case of cancellation of an order
1st case: you cancel an order that has allowed you to build up your kitty
The amount that will be refunded to you will be the amount of the item. The kitty will be canceled.
2nd case: you use your kitty on an order that you then cancel. You will be reimbursed for the amount paid. The kitty will be re-credited.
3rd case: you cancel an order that allowed you to benefit from a prize pool on a subsequent order. You will be refunded the amount of the returned item minus the Kitty you subsequently benefited from. (For example, you order an item for €300 which entitles you to €10 in prize money, if you use the prize money for a new order and return the first item, you will be refunded €290)
Article 14 - Intellectual Property
All texts, comments, illustrations, and images reproduced on the www.planete-sfactory.com website are reserved under copyright law and intellectual property law for the entire world. As such, and in accordance with the provisions of the Intellectual Property Code, only private use is authorized. Any other use constitutes an infringement and is punishable under the Intellectual Property Code, unless prior authorization has been granted by S-FACTORY.
Article 15 - Responsibility
The products offered comply with current French legislation. S-FACTORY shall not be held liable in the event of non-compliance with the legislation of the country where the products are delivered. S-FACTORY shall not be held liable in the event of force majeure, disruption, or total or partial strike, in particular of the postal services and means of transport and/or communications, flooding, or fire.
Article 16 - Applicable Law - Disputes
This contract is subject to French law and is written in French. In the event of a dispute, only the French courts are competent to rule.
Article 17 - Personal information
S-FACTORY undertakes not to divulge to third parties the information you provide. This information is confidential and will only be used by S-FACTORY's internal services to process your order and/or to make you benefit from promotional offers. Confidentiality: S-FACTORY only collects the data that is strictly necessary for the proper processing of your orders or to inform you of the advantages and news we wish you to benefit from. The following is never communicated to third parties: The information you give when filling in different forms: subscription to the newsletter, subscription to the S-FACTORY Club, registration of your online purchase, placing an order.
